How is the date of the sales fixed? According to the DGCCRF, Directorate General of Competition, Consumer Affairs and Fraud Control, dependent on the Ministry of Economy, seasonal sales (summer and winter sales) must legally extend over a period of six weeks [NDLR : en janvier 2019, cette durée pourrait être ramenée de 6 à 4 semaines par la loi Pacte mais n'est pour l'instant pas officialisée comme telle par le site de l'administration française, service-public.fr]. It is an article of law which determines the exact dates of beginning and end of the balances: Article D. 310-15-2 of the Commercial Code. The latter was drafted in the Law of Modernization of the Economy of 4 August 2008. According to its terms, the start date of the winter sales is set for the second Wednesday of January and markdowns can begin at 8 am For summer sales, it's the last Wednesday of June which is the fateful date, always at 8 o'clock.
Some exceptions may disrupt this mechanism, especially if the date of the winter sale falls after the 12th, in which case the balances start on the first Wednesday of January. Similarly, if the date of the summer sale falls after the 28th, then the balances start on the penultimate Wednesday of June. The DGCCRF adds that these dates are valid for the sale in store, as for the distance selling, in other words selling over the Internet. And this regardless of the location of the company's headquarters. To know Online sales must respect the same dates as store sales, regardless of the site or brand.
