20 minutes – Withdrawal of nationality from an IS supporter

A woman from French-speaking Switzerland is expected to lose her nationality due to her ties to IS. The 30-year-old Franco-Swiss probably let the appeal period pass against the withdrawal of her citizenship ordered by the State Secretariat for Migration.

It remains to be seen whether the woman filed a timely appeal with an embassy abroad, said an employee of the Federal Administrative Court of St. Gallen, following an information on Tuesday evening from the radio and the Swiss German television SRF . If such a call exists, it should be received in the coming days.

Otherwise, the withdrawal of his civil rights will become effective early next week. Aged 30, the woman who also has French nationality is from Berolle, a Vaud municipality located in the district of Morges.

The Tages-Anzeiger website reported in early January that the woman was born and raised in Geneva. In 2016, she left for Syria in the territories under the control of the Islamic State (IS) organization with her two daughters, unbeknownst to them. On the spot, she married a fighter who was killed during a drone raid in 2018.

A first case in September

It would only be the second time since the Second World War that a Swiss person would be naturalized. In September, the State Secretariat for Migration (SEM) had already revoked the passport of a Turkish-Swiss binational. The man had already been sentenced to several years in prison by the Federal Criminal Court in 2017 for making propaganda for IS and recruiting fighters for the Sunni terrorist group.

The SEM may withdraw Swiss nationality from a person with dual nationality if that person has caused considerable damage to the interests or reputation of Switzerland and thus endangers the security of the country.

The law already provides that nationality may be withdrawn from a dual national if his conduct seriously prejudices the interests or the reputation of Switzerland. According to the authorities, this is the case, for example, if the person has committed a serious crime in connection with terrorist activities or violent extremism. Decisions should, however, be made on a case-by-case basis.

However, withdrawal of the Swiss passport is only possible if the person concerned has another nationality. Otherwise, Switzerland would create stateless persons, which is prohibited by international law.
