With a kiss on the air towards his relatives, Jeton G. * left the court room of the Zurich District Court on Wednesday. This had sentenced the 36-year-old Swiss with Kosovar roots to 16.5 years imprisonment for premeditated and attempted killing – the maximum sentence within the possible framework. Jeton G. shot the martial artist and hooligan B.R. * in Zurich-Affoltern in 2015 when he ran away in a dispute.
The court said that several people testified credibly about how Jeton G. targeted the fleeing men. There is also no evidence that someone from the victim’s group carried and fired another weapon. The fact is, however, not a murder: “A special unscrupulousness is to be denied.” It was the end of a long dispute that had been fought with hard bandages from both sides.
No safekeeping
The court also refrained from keeping Jeton G. in custody because the conditions are not met. Despite the currently unfavorable prognosis, it cannot be determined that he will commit serious crimes again after his release. “The long prison sentence gives him the opportunity to work on himself in the penal system.”
Jeton G.’s defense lawyers say the verdict is a first step in the right direction. But the penalty is too high. During the trial, they had already announced that they would take the case to the European Court of Human Rights in Strasbourg.
Father was wearing a red shirt
Jeton G.’s wife would have wished for a deeper sentence: “It was a bad day for me,” she said after 20 minutes. But what she is currently more concerned with is the red shirt that the father of the victim B.R. at the pronouncement of judgment and also on earlier trial days. «That means blood revenge. I am really very afraid for my children, »says the wife.
According to R.’s father’s lawyer, Inge Mokry, the red shirt is a provocation. Already during the investigation almost five years ago, that with the red shirt and blood vengeance was an issue. «Nothing has happened so far. Provoking doesn’t mean performing, »says Mokry.
The father had even been asked by the police not to wear red clothes to open the sentence. “But he couldn’t have it forbidden.” The court got the best out of the judgment, says Mokry. “I will now try to convey this to my client.”
Also convicted of two co-accused
In addition to Jeton G., the two co-accused were also convicted. The ex-colleague who took Jeton G.’s gun was acquitted of the allegation of helping him to be killed. However, the 25-year-old Turk receives a partial prison sentence of three years for other offenses. The third accused receives a conditional prison sentence of twelve months.
