On September 17, 2020, more than 2,200 customs officers from the financial control of undeclared work (FKS) examined the courier, express and parcel service sector in a nationwide examination. During the focus check, the FKS checked in particular compliance with the statutory minimum wage under the Minimum Wage Act, compliance with social security obligations, the illegal receipt of social benefits and the illegal employment of foreigners. The general minimum wage of 9.35 euros per hour has been in force in this sector since January 1, 2020. The subcontractor liability, which has been in force since July 1, 2020, was also checked. The subcontractor liability regulates the fulfillment of the payment obligation and social security contributions for entrepreneurs who are active in the field of courier, express and parcel services. The emergency services interviewed around 8,000 people about their employment relationships and checked the company’s business documents in over 250 cases. The findings so far led to the initiation of 16 criminal proceedings for fraud, illegal residence without a residence permit and forgery of documents. In addition, 36 administrative offense proceedings were initiated mainly due to employment without a work permit and the failure to carry identity documents. In around 1,600 cases, further clarifications of the facts are required by the VCS. The exams have not yet been completed. The financial control of illegal work at the main customs office in Krefeld supported the nationwide examination with 35 emergency personnel. The main areas of activity were the checks on the courier services in the Krefeld, Mönchengladbach, Neuss and Viersen / Kempen districts. An initial evaluation and a comparison with the previously submitted documents resulted in the following findings:

besteht der Verdacht auf Scheinselbständigkeit
